Copyright Infringement Policy and Procedures

Introduction

New-Game.org respects the intellectual property rights of others and expects users of our services to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and have established the following policy to address copyright infringement claims.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site, please notify us immediately.

Copyright Infringement Notification

To file a notice of infringement with us, you must provide a written communication that sets forth the items specified below. Please note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights.

Your notice must include the following information:

  1. Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Location: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  4. Contact Information: Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. Statement of Good Faith: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Statement of Authority: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification

If you believe that your content that has been removed or disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must include the following information:

  1. Signature: A physical or electronic signature of the subscriber.
  2. Identification: Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
  3. Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Consent: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which New-Game.org may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received, we may send a copy of the counter-notice to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice.

Repeat Infringers

We reserve the right to terminate, in appropriate circumstances, users and/or account holders who are repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe upon the intellectual property rights of others.

Modification of Policy

We reserve the right to modify this DMCA policy at any time. Changes will be posted on this page with an updated revision date. Your continued use of our website after any changes to this policy constitutes your acceptance of the modified policy.
